Many of the enquiries we receive are from executors of deceased estate's who are looking for a second opinion of a property valuation. Valuing a property can be quite subjective, so valuations can vary quite considerably.
This is especially the case if a property requires refurbishment (which many probate properties do), the cost of refurbishment for a professional builder who might be interested in renting the property as an investment will clearly be less than the cost for a first time buyer. Is a grant of probate required before the property sale?
The short answer is that grant of probate is required. But that doesn’t stop you from making plans to sell.
Without a grant of probate there is no evidence to show the legal chain of ownership from the person who owned the house (the deceased) to the person wishing to sell (the executors or the administrators). So until the grant is issued there will be no rights to sell the property despite the executors being named in the will.
The personal representatives are allowed to begin marketing the property or making contact with prospective buyers but they cannot enter into the contract of sale until the grant is issued. Any prospective buyer (or their solicitor) will require a certified copy of the grant.

Is there a deadline for payment of inheritance tax to HMRC?
Information obtained from gov.uk states that you have one year from the date of death to fill in Inheritance Tax forms if there’s Inheritance Tax to pay. And you will have to start paying Inheritance Tax by the end of the sixth month after the death whether you have completed your forms or not - you can make a payment before you finish valuing the estate.

How long does probate take where property is involved?
The length of time probate takes depends upon the size of the estate. The starting point is to value the Deceased’s assets and liabilities. Thereafter, the inheritance tax returns can be completed and the application to the probate registry made. Once the grant is issued the various assets can then be collected, and the estate distributed. For estates involving inheritance tax, usually where a property is included in the estate it can take up to 5 months. Those cases were the Estate is under the inheritance tax threshold are often much quicker to conclude and typically can take anything between 2-3 months.
What insurance cover is required for a probate property?
Many insurance policies become invalid if a property is unoccupied, usually for a period of 6 weeks. If there is already an insurance policy for the property then it’s important to let the insurer know that the property is now unoccupied – they will update the existing policy and advise you to make sure certain things are carried out, most insurers will require that the water header tank (if there is one) is drained down, that the letterbox is sealed and that the property is regularly inspected.
